The documents you need to set up an employment agency

Placement agencies, also known as “temporary employee recruitment agencies”, are agencies specializing in the recruitment of profiles on behalf of client companies for a fixed term.

In order to create your own employment agency, you have to go through a number of steps: obtaining the prior agreement of the labor inspector, choosing the legal status, drafting the business plan, and registering and obtaining the Kbis extract.

The choice of the legal status of your employment agency will affect several aspects of your future activity, including the taxation of your profits. Choose your status according to the planned size of your company. For example, if you plan to set up alone and without employees, opt for the status of individual entrepreneur, if you are with one or more employees, the LLC is more appropriate…etc.

Before setting up your placement agency, you must first send a declaration to the labor inspector. Complete the CERFA form n°61-2183. You should mention a few important points:

Three copies of this declaration must be sent by registered mail to the attention of the labor inspector responsible for the address of the agency to be created. After approximately 15 days from receipt of this declaration, the inspector will send you a copy without which you cannot start the activity.

You will need to draw up a well-detailed business plan which will present your project to create an employment agency and validate its profitability. It is in this document that your strength or your weakness will lie in your efforts to convince potential investors. The business plan must contain a market study, a forecast income statement, the company’s forecast balance sheet and the forecast working capital requirement, in addition to general information about the company.

Finally, you must register your placement agency with the Trade Register. These formalities must be carried out with the CFE of the Chamber of Commerce and Industry. You must send the following documents: A completed and signed P0 form, your proof of premises, a copy of your identity card, a sworn declaration of non-conviction dated and signed, and payment by check of the creation costs , proof of contributions of funds. Other documents may be requested depending on the nature of the legal status chosen.
